Resumo: This study strives to explore the critical arguments concerning the discussion about neurosciences and criminal liability, due to some opinions of the neuroscientific field that argued that free will doesn't exist and would be merely an illusion created by our brain. Therefore, many critics claimed a new basis for the attribution of responsibility on criminal law. Thus, we dedicate to review the most relevant arguments within the neurosciences, of legal dogmatic’s and philosophers who have studied the subject in order to contribute to the knowledge of the current state of the debate.

Thus, we dedicate to review the most relevant arguments within the neurosciences, of legal dogmatic’s and philosophers who have studied the subject in order to contribute to the knowledge of the current state of the debate.Este trabalho busca investigar o atual estado do debate entre neurocientistas e juristas acerca da responsabilidade penal. Para tanto, realizou-se uma revisão bibliográfica e interdisciplinar dos principais cientistas e juristas que trataram do assunto. A pesquisa também explorou o posicionamento de filósofos quanto ao movimento científico e as críticas tecidas pela neurociência recente que, como fim último, reivindica uma nova roupagem científica ao Direito Penal, especialmente à responsabilidade penal. Diante disso, a questão central que norteia a presente investigação estabeleceu-se como: “Qual o limite de abertura do Direito Penal à neurociência?”. Verificou-se, a partir disso, que o Direito Penal só pode limitar sua abertura aos aspectos científicos da atual neurociência, supresso, portanto, seus traços ideológicos. Além disso, baseado nas conclusões retiradas da análise da literatura do tema, as duas hipóteses inicialmente delineadas restaram não confirmadas, sendo elas: a) a hipótese de que ninguém mais será julgado responsável por seus atos; b) e a hipótese de que a interpretação do Direito será dada pela neurociência.
