Resumo: The paper aims to demonstrate that the foundation of the “village” of São Sebastião do Rio de Janeiro by Estácio de Sá represents an anomaly within the context of the administrative rules of the Portuguese Crown in respect to the rights of occupation of urban areas. In light of the construction of an overseas network by Portugal, the paper discusses the reasons for such transgressions of the rules of geographical occupation.

Discutimos las razones de tales infracciones a las normas impuestas por la Corona Portuguesa en América.Objetivamos demonstrar que a fundação da "vila" de São Sebastião do Rio de Janeiro expressa uma anomalia às normas administrativas da Coroa referentes aos direitos donatários e caracterização dos espaços urbanos.
