Resumo: The legal structure established by policies on indigenous peoples in Brazil, in the second half of the 18th century, was aimed at the assimilation of native peoples. This same structure also established rights for indigenous people, who learned to claim them through institutions. This article analyzes the indigenous actions of the Paiaku from Montemor, in the first decades of the 19th century, in the attempt to guarantee their rights.

Esta misma estructura también estableció derechos para los pueblos indígenas, quienes aprendieron a reclamarlos por medio de instituciones. Este artículo analiza las acciones indígenas de los Paiaku de Montemor, en las primeras décadas del siglo XIX, en un intento por garantizar sus derechos.A estrutura jurídica estabelecida pelas políticas indigenistas no Brasil, na segunda metade do século XVIII, estava voltada à assimilação dos povos nativos. Essa mesma estrutura também estabeleceu direitos aos indígenas, que aprenderam a reivindicá-los através das instituições. Este artigo analisa as ações indígenas dos paiakus de Montemor, nas primeiras décadas do século XIX, na tentativa de garantir os seus direitos.
