Resumo: The 1824 Federal Constitution of Brazil does not mention the indigenous peoples, and this has generated different historiographical interpretations about the political and legal place of native peoples in the process of independence and nation building. The aim of this article is to problematize the indigenous peoples’ rights in the process of the political emancipation in Brazil, prioritizing the fundamental rights to life, freedom and land in two periods.
