Resumo: The present report is a result of my Curricular Internship, developed in Lisbon’s Family Court. The selection of the subject under discussion stems from the confrontation with a varied number of post-separation cases of regulation and exercise of parental responsibilities involving the phenomenon of parental alienation. Considering a controversial behavior that undermines the Best Interest of the Child, preventing the child from establishing a secure affective bond with both parents, this study aims to identify its characterizing elements, its consequences for the minors and the importance of hearing the child in its recognition. With a view to prevention and solution of the phenomenon, the applicable legal instruments and options such as Joint Custody are also analyzed.

Face a um comportamento controverso que coloca em causa o Superior Interesse da Criança, impedindo a criança de estabelecer uma vinculação afetiva segura com ambos os progenitores, este estudo visa identificar os seus elementos caracterizadores, as suas consequências para os menores e a importância da audição da criança no seu reconhecimento.
