Analysis of the performance of the concepts of modern society and risk society as the basis of a “modern” criminal law for Latin America

From the beginning of the century, criminal law researchers began to use the expression “modern society” or “risk society” – among others – to justify some important changes in dogmatic institutes essentials to the system. This investigation had and still has repercussions in Latin America, especially in Brazil. According to these researchers, risk becomes a new element, justifying an equally new criminal law. The purpose of this text is to analyze the aforementioned expressions and the performance of the concept of risk for a “new” criminal law, a “modern” criminal law, especially if it is useful for the construction of something really new or if it just should be adapted and inserted into an already functional system.
