The present report was written following a five-month internship at the Central Criminal Court of Lisbon as part of my Master’s Degree in Forensic Law and Arbitration. This internship allowed me to directly engage with different legal cases and to attend legal hearings on a daily basis which proved to be extremely beneficial for me to have a better understanding of some of the subjects that were taught during my bachelor’s and master’s degree, specially in the field of procedural law. Considering the number of consulted cases and attended trial hearings, I decided to focus on the topics that captivated my interest the most and proved to be more challenging. One of the cases that I had the opportunity to follow and that sparked my interest involved a homicide committed by an unaccountable defendant. After reflection, I decided to choose unaccountability as the central focus of this report since it was a theme that I found specially interesting and remains highly relevant. In particular, I aimed to address this topic through the lens of the principle of dangerousness, which holds an extreme importance in matters of security measures and the law of the unaccountable individuals. Lastly, I considered it important to discuss a legislative proposal that, if approved, could potentially eliminate the option to extend the internment of dangerous unaccountable individuals. Given the current relevance of this matter, I concluded it was necessary to analyze it and present my perspective.
