However, as in any field of science that directly intervenes in the human being, the ethical and moral questions that arise in the field of Medically Assisted Reproduction are broad. Therefore, it will be necessary an intervention of the Law, so that, taking into account these issues, this theme will be regulated through norms that seek to guarantee the fundamental rights of individuals, but that allow the continuous development of science.The present study aims to approach to one of the several themes that medically assisted reproduction techniques involve, focusing on the issue of the right to know one’s genetic origins, the possibility of accessing the identity of the gamete donor and his confrontation with the right to reserve his private and intimate life. Thus, passing through the spectrum of the way in which parenthood is established in our legal system and the strength that affections have reached for the constitution of family ties, this study intends to analyse, based on Portuguese doctrine and jurisprudence, the substrate of the right to know one’s genetic origins, why principles are guided and how genetics becomes the protagonist again to justify the fall of another constitutionally protected right.Considering the incumbent regimes in foreign legal systems for a better understanding of the theme and the positions adopted, we commit ourselves, with the critical spirit that a jurist is asked to, to analyse the conflict of interest in question, asking what is the best solution in order to effectively understand the scope of the right to know one’s genetic origins and to conclude with a possible harmonization of this fundamental rights in confrontation game.Com o constante desenvolvimento da tecnologia e os avanços na área da biomédica, a infertilidade já não se revela mais como uma condição inultrapassável sinónimo de impossibilidade na obtenção da prole. Não obstante, tal como em qualquer campo da ciência que intervenha diretamente no ser humano, muitas são as questões éticas e morais que se levantam no campo da Procriação Medicamente Assistida. Assim, será necessária uma intervenção do Direito para que, tendo em conta tais questões, se regule esta temática através de normas que procurem garantir os direitos basilares dos indivíduos, mas que permitam o contínuo desenvolvimento da ciência. O presente trabalho versa sobre um dos vários temas que as técnicas de procriação medicamente assistidas comportam, tendo-nos focado na questão do direito ao conhecimento das origens genéticas, na possibilidade de se aceder à identidade do dador de gâmetas e do seu confronto com o direito do mesmo à reserva da sua vida íntima e privada. Assim, passando pelo espectro do modo de estabelecimento da filiação no nosso ordenamento jurídico e da força que os afetos têm alcançado para a constituição de laços familiares, este estudo pretende analisar, com base na doutrina e jurisprudência portuguesas, o substrato do direito ao conhecimento das origens genéticas, por que princípios se norteia e de que modo a genética volta a ser protagonista para justificar a queda de outro direito constitucionalmente tutelado.
