Resumo: In this study the Author sets out to consider the current crisis of the garantistic model of contemporary criminal law as this is subject to a continuous process, not of mere change and transformation, but of true metamorphosis. The Author does so with the confessed purpose of conveying a new approach to the criminal garantistical tradition that is able to recall its original source as a model of true deslegitimation. Only then will it be possible to reinstate criminal law in its role as a guarantor of human rights, in a way that is congruent with the critical function it must perform in a State subject to the rule of law, hence reliant on the affirmation of individual dignity as the supreme value recognized in each individual person.
