Resumo: | Arbitration is a form of alternate dispute resolution, that takes place outside the court of law. Arbitral tribunals are usually not bound by domestic procedures for collection and evaluation of evidence. There exists a vacuum with respect to laws relating to evidence in International arbitration, making it imperative to examine the rules of evidentiary collection and examination in arbitral tribunals. This paper seeks to examine the procedure relating to the admissibility and relevance of evidence in international arbitration. Parallelly, this paper will also examine the differences in procedure in Civil and Common law jurisdictions, the practical effect of these differences and the implications of the same. |

Os tribunais arbitrais não estão geralmente vinculados à observância de regras legais que versem sobre os meios de obtenção da prova e sobre o valor probatório dos diversos meios de prova. Em face do vazio legal no que respeita à prova na arbitragem internacional, analisam-se as regras que versam sobre os meios de obtenção e a valoração da prova nos tribunais arbitrais. Neste artigo, procura avaliar-se a admissibilidade e o valor da prova na arbitragem internacional.
