Com efeito, a teoria da interconstitucionalidade é assumida e experimentada no direito da União Europeia, motivo pelo qual se questiona se ela pode ser aplicada, em algumas de suas características, também no Sistema Interamericano de Direitos Humanos, contribuindo, dessa forma, para alcançar um padrão mais elevado de efetividade das decisões no âmbito desse sistema regional. Eis, portanto, o problema que esta pesquisa se propõe a investigar. Registra-se, pois, num mundo globalizado, em que culturas, conhecimentos científicos, desafios e fatores de risco interagem e se expandem, sem encontrar limites fronteiriços, que aflora e se eleva um novo modelo de Estado e de constitucionalismo. E, assim, a teoria da interconstitucionalidade reflete uma alternativa de proteção aos direitos a serem tutelados nesse novo cenário. O marco teórico proposto tem como prelúdio o direito da UE e pode contribuir ao resguardo dos direitos humanos e fundamentais dos cidadãos não apenas de um Estado, mas de todos aqueles que compõem essa nova forma de organização do poder político, numa perspectiva de integração de normas e fortalecimento da rede de garantias. Esse entrelaçamento desenha o formato da interconstitucionalidade, em atos normativos que, muitas vezes, interagem e se harmonizam, mas, por outras tantas, colidem e até se sobrepõem. Desse modo, num ambiente contemporâneo de globalização, em que os direitos humanos, individuais e sociais, não recebem a devida proteção pelas legislações internas dos Estados, o adensamento dos padrões jusfundamentais tem a capacidade de reverter esse quadro e diminuir o risco de perecimento dos direitos. A pretensão da pesquisa, destarte, traduz-se no desejo de investigar se o novo modelo de constitucionalismo ecoa além dos muros europeus, rumando aos Estados partes da Organização dos Estados Americanos (OEA) e que ainda registram situações de violação aos direitos humanos. Nesse plano político, sem romper a soberania de cada Estado, poderia a teoria da interconstitucionalidade servir à edificação de um novo diálogo na integração das normas e, assim, cooperar em prol de um efetivo modelo de proteção?This Dissertation is within the area of concentration "Fundamentals of Positive Law", linked to the line of research "Constitutionalism and Production of Law". In effect, the theory of interconstitutionality is assumed and experienced in European Union law. Therefore, it is questioned whether it can also be applied, in some of its characteristics, to the inter-American system of human rights, thereby contributing to achieving a higher standard of effectiveness of decisions within that regional system. This, then, is the subject of investigation of this study. It is in a globalized world, in which cultures, scientific knowledge, challenges and risk factors interact and expand, without boundaries, that a new model of State and constitutionalism rises. Thus, the theory of interconstitutionality reflects an alternative means of protecting the rights to protection, within this new scenario. The prelude to the proposed theoretical framework is EU law, and it can contribute to safeguarding the human and fundamental rights of citizens, not only of a State but also of all those who make up this new form of organization of political power, from a perspective of integration of norms and strengthening of the network of guarantees. This interweaving creates the outlines of an interconstitutionality, in normative acts that sometimes interact and harmonize, but sometimes clash and are even overlap with each other. Thus, in a contemporary context of globalization, in which human, individual and social rights are not adequately protected by the internal laws of States, the densification of jus-fundamental standards is able to reverse this situation and reduce the risk of perishing of rights. The intention of this research, therefore, is to investigate whether the new model of constitutionalism has echoes beyond European walls, moving towards the member States of the Organization of American States (OAS) that still have situations of human rights violations.
