This emerged in the wake of the development of the so called Society of Information and the consequent infiltration of the technology in the daily activity of Public Administration, offering the most varied advantages. However, since its beggining, its nature (whether it will actually be Administrative Acts) and its legal framework (if the legislation currently in force is sufficient) has been questioned, which is not a purely theoretical issue. This response has practical implications, especially with regard to the Public’s guarantees. Thus, in this work, after contextualizing the emergence of these Electronic Administrative Acts, we propose to answer whether effectively the current law answers all the questions raised by the use of electronic mechanisms by the Administration in its performance, or if on the contrary, it is necessary to invest in legislative productions.The conclusion seems to be that, indeed, there is a gap to be corrected in the Portuguese legislative system, which has not yet provided this figure specifically and in detail. Such a failure has the consequence that it is not possible to guarantee homogeneous treatment, to guarantee that all demanding procedures are complied with and that citizens' rights are properly protected. In this paper we specifically address the theme of Civil Responsibility, as it seems to be the area that suffers the most as it is not rigorously legislated.Os Atos Administrativos Eletrónicos são uma figura muito recente no ordenamento jurídico português, e que, por isso, suscita muita curiosidade. Esta surgiu no embalo do desenvolvimento da Sociedade da Informação e a consequente infiltração das tecnologias na atividade quotidiana da Administração Pública, oferecendo as mais variadas vantagens. Contudo, desde o início, tem sido questionada a sua natureza (se serão efetivamente Atos Administrativos) e o seu enquadramento legal (se a legislação que vigora atualmente é a suficiente), o que não é uma questão meramente teórica. Esta resposta tem implicações práticas, especialmente no que concerne às garantias dos Administrados.Assim, neste trabalho, depois de uma contextualização do surgimento destes Atos Administrativos Eletrónicos, propomo-nos a responder se efetivamente a lei vigente responde a todas as questões levantadas pela utilização de mecanismos eletrónicos pela Administração na sua atuação, ou se pelo contrário, é necessário investir na produção legislativa.A conclusão parece ser, que efetivamente, existe uma lacuna a corrigir no sistema legislativo português, que ainda não previu especificamente e de forma pormenorizada esta figura. Tal falha tem por consequência que não se consegue garantir um tratamento homogéneo, garantir que todos os procedimentos exigentes são cumpridos e que os direitos dos cidadãos são devidamente tutelados.
