Este instituto tem vindo, ao longo dos anos, a sofrer alterações na sua redação no que respeita aos seus pressupostos e âmbito de aplicação, atualmente reconduzido a uma mais ampla panóplia de crimes face àquela prevista na sua redação original. Atualmente, é possível aplicar suspensão provisória do processo a processos por crimes de violência doméstica não agravados pelo resultado. Na presente Dissertação partiremos, em primeira linha, da análise do regime legal deste instituto, para em seguida apurar a sua compatibilização com a tutela oferecida pelo crime de violência doméstica, previsto e punido pelo artigo 152.º do Código Penal. Percorrido o aludido trajeto, demos conta de uma dificuldade em harmonizar a simplificação característica da suspensão provisória do processo com a complexidade dos comportamentos típicos de violência doméstica. Tal dificuldade é motivada pelos termos em que se molda o regime especial do n.º 8 do artigo 281.º do CPP, e adensada pelas formulações a que recorre. Centrámo-nos, assim, na problemática relativa à agravação pelo resultado quando em causa estejam maus tratos psíquicos, nos pressupostos que ditam a aplicação do instituto no âmbito do crime de violência doméstica, na compaginação com a atual natureza pública do crime e com a possibilidade de recondução ao seio do artigo 152.º CP de maus tratos não reiterados.The provisional suspension of proceedings is a procedural provision which application will determine a change in the traditional way criminal proceedings are conducted, by making them swifter, more economical and effective.Over the years, this provision has undergone changes in its wording with regard to its assumptions and scope of application, and currently applies to a wider variety of crimes than those provided for in its original wording. Currently, it is possible to apply provisional suspension of proceedings to cases of domestic violence which are not aggravated by the result.In this dissertation we will start by analysing the legal system of this provision and then examine its compatibility with the protection offered by the crime of domestic violence, which is provided for and punished by article 152 of the Portuguese Criminal Code.After having completed the above-mentioned analysis, we have noticed that it is difficult to harmonize the simplification characteristic of the provisional suspension of proceedings with the complexity of the typical behaviours of domestic violence. This difficulty is motivated by the terms in which the special regime of article 281(8) of the Portuguese Code of Criminal Procedure is framed and is increased by the formulations it uses.
