In a time of endless statements, distracting noise and impetuous debates, in which every kiss, decision or appeal — of love or hate — is digitally encrypted, corseted in indeterminate servers and inaccessible jurisdictions, one subject has remained notoriously absent: the capital balance between privacy, an equivocal and undiscussed concept that commonly embodies the natural and legitimate desire to keep data and information away from unsought eyes and ears, and the need for Justice to occasionally, legally and legitimately access them. The present thesis scrutinizes the multiple aspects of a historical context that offers a world where Justice is, with no reflection or compromise, progressively hindered or unfeasible. The geneses, causes and consequences of the increasingly challenging access to essential digital evidence — already critical in most criminal offenses —, progressively dependent on rules and conditions unilaterally defined by businesses in the context of their own interests, will be scrutinized. Solutions will, finally, be considered: those already enacted or implemented; those being considered. And the others: pragmatic, realistic proposals that are compatible with contemporary global politics, economics and legal frameworks.
