A comparative study between “dolo ilícito” in Portuguese Law, fraudulent misrepresentation in English Law and fraud in DCFR

Resumo: This article compares the framework of “dolo ilícito” as a vice of the will of business declarations in the Portuguese legal system, the framework of fraudulent misrepresentation in English Law and the framework of fraud in the Draft Common Frame of Reference contracts. These institutes play a similar role in their respective systems, making them eligible for comparison. In order to offer a reliable view of these three institutes and their respective framework, the typical legal consequences are also compared, namely, the invalidity and the indemnity regime, and they are distinguished from related categories. The application of these institutes, as law in action, is also considered in order to better understand their manifestations in the social context and the practical relevance of these regimes.

Os regimes elencados desempenham uma função semelhante nos respetivos sistemas, tornando o seu conteúdo elegível para comparação. Por forma a oferecer uma visão fidedigna destes três regimes, comparam-se igualmente os regimes jurídicos das respetivas consequências jurídicas típicas, a saber, o regime da invalidade e o regime indemnizatório, sendo igualmente distinguidos de institutos jurídicos afins, permitindo uma delimitação negativa.
