Nele, será dado especial enfase aos inconvenientes que o instituto gera, oferecendo-se a análise de uma nova tendência jurisprudencial que reflete os reparos que iriei enunciar e que devem operar aquando a sua aplicação. Recaindo o trabalho sobre uma temática onde existe uma multiplicidade de entendimentos, é relevante o estudo de todas aquelas que marcam o entendimento predominante em Portugal e influenciaram a minha investigação. Este trabalho versa sobre a problemática da desconsideração da personalidade jurídica das sociedades comerciais e pretende analisar a evolução jurisprudencial e doutrinal em relação a este tema.
