Resumo: | The police concept, that keeps up with the essence and development of nations, has a fundamental role in the State for the maintenance of public order and for the free and safe exercise of rights. However, and as is normal and associated with the human condition, the law enforcement agencies known today have been controlled when it comes to their actions, because with globalization and the growing of new information platforms, the citizen presents himself as enlightened and rigorous, meaning that most of society knows what to expect when intercepted by those law enforcement agencies. Thus, there have been an increase in mediatic and controversial cases about the performance of the security forces, namely in the media and social networks, in which the legitimacy of police officers for certain acts is questioned, and a disproportionate use of force is often alleged. In reality, the free will associated with the security forces can happen, but it is not justified by law, since the police are only allowed to do what is typified by law. It is from this starting point that we justify our investigation, as there is, in Portugal, the General Inspection of Internal Administration whose main function is to supervise and control whether the functions of the security forces and services are being carried out and processed within the limits defined by law, which, in addition to being restrictive, they generate a connection and complementation with the goal of having a safe, free society, able to exercise rights and duties in a healthy environment conducive to evolution. The aim of this dissertation lies in the investigation of how the General Inspection of Internal Administration can be seen as a mechanism against police violence, exemplifying actions carried out by law enforcement agencies that lead to distrust of the population towards those entities, delimiting the study to certain police forces that are in closer contact with the citizen, and navigating through the legal norms and principles of the democratic rule of law to which their action is subject. |

No entanto, e como é normal e associado à condição humana, as forças de segurança que hoje conhecemos têm estado com todos os olhos virados para a sua atuação, porquanto com a globalização e o aumento exponencial de plataformas de informação, o cidadão apresenta-se crescentemente esclarecido e rigoroso, pelo que a maioria da sociedade sabe o que esperar quando intercetados por estas. Assim, têm surgido cada vez mais casos mediáticos e polémicos sobre a atuação das forças de segurança, nomeadamente nos media e nas redes sociais, em que a legitimidade destas para certos atos é questionada, e alega-se frequentemente um uso desproporcional da força. Na realidade, a discricionariedade associada às forças de segurança pode acontecer, mas não é justificada por lei, já que o polícia apenas está permitido a fazer o que está tipificado legalmente. É neste ponto de partida que justificamos a nossa investigação, por existir, em Portugal, a Inspeção-Geral da Administração Interna que tem como função principal fiscalizar e controlar se as funções das forças e serviços de segurança estão a ser executadas e tramitadas dentro dos limites impostos, sendo estes, além de restritivos, uma panóplia que se conecta e complementa para que a sociedade esteja segura, seja livre e possa exercer os restantes direitos e deveres num ambiente saudável e propício à evolução.
