Tal abordagem se fundamenta na teoria do bem jurídico como padrão crítico da atividade legislativa do Estado. Ao revisitar os conceitos basilares que fundamentam a teoria do bem jurídico e realizar uma análise dos trabalhos preparatórios que culminaram na aprovação da lei, o incluso trabalho se propõe a questionar a legitimidade da nova norma incriminadora. Ante à ponderação de que a teoria do bem jurídico se mantém viva como critério apto a nortear a atividade legislativa estatal, os esboços teóricos que propõem conferir legitimidade a Lei n.º 69/2014 através da pretensa identificação de um bem jurídico com dignidade constitucional naquela norma, representam, em última análise, esforços que desconsideram tal função, ao invés de, ao contrário, reafirma-la.Pretendemos assim, com o desenvolvimento de toda a pesquisa realizada, chegar a ao ponto conclusivo de que novos crimes de maus tratos e abandono de animais de companhia inseridos no ordenamento jurídico português, tratam-se, indubitavelmente, de incriminações com questionável legitimidade em razão da impossibilidade de identificação do bem jurídico tutelado naquelas normas, aferição imprescindível diante dos moldes que o direito penal deve se pautar em um Estado Democrático de Direito.This study was elaborated within the scope of the Master's Degree in Juridical-Criminal Sciences and proposes to take an approach on the novel legislation inserted in the Portuguese legal system - Law no. 69/2014 - on the protection of animals against acts of mistreatment and neglect. Such an approach is based on the theory of legal good as a critical standard of state legislative activity. In revisiting the basic concepts underlying the theory of legal good and analyzing the preparatory work that culminated in the adoption of the law, the work itself proposes to question the legitimacy of the new incriminating norm. Faced with the consideration that the theory of legal good is still alive as a criterion to guide state legislative activity, the theoretical sketches that propose to confer legitimacy Law No. 69/2014 through the supposed identification of a legal asset with constitutional dignity in that standard, represent, ultimately, efforts that disregard such a function, rather than, on the contrary, reaffirm it.
