Este direito surge da luta dos familiares das vítimas pela verdade sobre as graves violações aos direitos humanos ocorridas no antigo regime e consolida-se, em âmbito internacional, como um direito costumeiro e autônomo, tendo alcançado o caráter de norma imperativa, vinculando Estados, órgãos internacionais e indivíduos. Os Tribunais Internacionais passaram a reafirmar o direito à verdade, em seu âmbito individual e coletivo, bem como a exigir seu cumprimento em nível local, através da responsabilização internacional dos Estados e a condenação das leis nacionais de anistias, amplas e gerais, maior obstáculo à concretização do direito à verdade. Neste cenário, as Comissões da Verdade – órgãos autônomos e temporários – configuram, juntamente com os Tribunais, o melhor mecanismo para conferir aplicabilidade ao direito à verdade no âmbito nacional e assegurar o conhecimento sobre os fatos e as respectivas responsabilidades. Para tanto, se faz importante o estudo do caso brasileiro e a insistência do país em não discutir o passado, em razão da vigência de sua ampla lei de anistia. A discussão acerca do direito à verdade caracteriza-se como um diálogo em aberto, em que o relatório final da Comissão Nacional da Verdade precisa conviver com a crise política do país e com o conflito entre a decisão do Supremo Tribunal Federal, afirmando a constitucionalidade da lei de anistia, e a decisão da Corte Interamericana de Direitos Humanos, que entendeu nulo os dispositivos da lei que obstaculizam a investigação dos responsáveis pelas graves violações no regime militar. Assim, defende-se a importância do direito à verdade para a efetiva promoção dos direitos humanos no Brasil e a consolidação da sua democracia.This dissertation is dedicated to the study of the right to the truth, especially at the transitional justice period, in which countless countries had abandoned the authoritarian regime to contemplate democracy and the Rule of Law. This right arises from the victim’s family fight to the truth regarding serious human rights violations that happened in the previous regime and consolidates, internationally, as a usual autonomous right, having reached its status of imperative regulation, binding State, international organizations and individuals. The International Courts began to acknowledge the right to the truth, in its individual and collective extent, as well as demand its compliance in local sphere, through international States accountability and the rejection of the universal amnesties, the biggest obstacle to the right to the truth concretization. In this scenario, the Truth Commissions – temporary and autonomous organizations – represents, along with the Courts, the best mechanism to assure the right to the truth applicability nationwide and to preserve the knowledge over the facts and the respective responsibilities. Therefore, it is important to study the Brazilian case and its persistence in not discuss about the past, due to the current universal amnesty law. The debate on the right to the truth is characterized as an open dialogue, in which the final report from the National Truth Commission needs to deal with the national political crisis and with the clash between the Supreme Court, declaring the constitutionality of the Amnesty Law, and the Inter-American Court of Human Rights understanding, that considered null and void the provisions of law at issue that becomes an obstacle to the investigation of those responsible for serious violations during the military regime.
