Drug use in societies has shown a problem increasingly present today, being registered even in children. The problem worsens when consumption on a scale of "usage pattern" reaches addiction, especially in severe stage, when it becomes described as a type of mental disorder called "mental and behavioral disorder by the use of psychoactive substances." The adoption of extreme measures to medical and psychiatric treatment by the use of psychoactive substances such as compulsory detention even when it comes to children, it is possibly one of the controversial points of the thesis, especially because it is a procedure performed without the informed consent of the patient. However, fail to provide the necessary medical and psychiatric treatment would be the same as leaving them on the margins of society and curb their full development as human beings. Thus, the preparation of this thesis aims to analyze a serious problem, namely, the compulsory detention without the consent of patients, such as medical and psychiatric treatment, drug addicts children by court order [only] in Brazil and Portugal, for the protection of human dignity in the process to ensure their full development and social reintegration.
