Resumo: The crime statistics and the news of corruption in the political field in Brazil have aroused great concern for the Brazilian State and discussions in the academic community. Despite the legal dogmatics considering crime as a matter of Criminal Law par excellence, this work, based on the Law of Security, seeks to observe, from the dimensions of security, how the Brazilian State can confront organized crime and systemic corruption in the political field. Recently, some studies have shown that there is a relationship between government systems and corruption, which indicates that the criminal phenomenon may be linked to the political regime adopted by a country. Thus, the thesis is that criminality does not only result from socioeconomic problems and bad public policies, but is also strongly associated with the structuring of the State, so that improvements in the political regime can reflect positively on the reduction of organized crime. Therefore, we seek to explain the state of the art of Brazilian criminality, going through the numbers of violent crimes, characterization of violent organized crime in the country, which are driven by the action of politically organized crime through the illicit market of political influence, a phenomenon we call of democracide corruption. Subsequently, we use Security Law to deal with useful instruments in the containment of organized crime according to the dimensions by which security can be observed. In this sense, from the perspective of the dimension of security and sovereignty, we approach the relevance of intelligence and Judiciary Police activities, the first in a preventive viewpoint and the second by the repressive bias, in confronting organized crime of a violent and political nature and defense of democratic institutions. With regard to the dimension of security and citizenship, a concept of political security with anticipatory character is proposed through discouraging adherence to organized crime through the promotion of greater citizenship through broad representation and popular participation in politics. In this way, the Brazilian political regime established with the Constitution of the Republic of 1988 is approached, criticizing the structuring of the separation of powers, the Brazilian government system, which came to be called coalition presidentialism, in addition to other political institutes such as unrestricted reelection of parliamentarians, parliamentary amendments, exclusively proportional electoral system, campaign financing and independent candidacies. Therefore, the main objective of the study is to offer contributions to the design of an integrated security system that results in a holistic and more effective and efficient view of combating the actions of organized crime of a violent and political nature.

A despeito de a dogmática jurídica considerar o crime como matéria do Direito Penal por excelência, busca-se com este trabalho, alicerçado no Direito da Segurança, observar, a partir das dimensões da segurança, como o Estado brasileiro pode confrontar o crime organizado e a corrupção sistêmica no campo político. Recentemente, alguns estudos têm demonstrado que há relação entre sistemas de governo e corrupção, o que denota que o fenômeno criminoso pode estar atrelado ao regime político adotado por um país. Assim, a tese é de que a criminalidade não decorre apenas de problemas socioeconômicos e políticas públicas ruins, mas também está fortemente associada à estruturação do Estado, de modo que aprimoramentos no regime político podem refletir positivamente no arrefecimento da criminalidade organizada. Para tanto, buscamos explicitar o estado da arte da criminalidade brasileira, passando pelos números dos crimes violentos, caracterização do crime organizado violento no país, que são impulsionados pela ação da criminalidade organizada de natureza política através do mercado ilícito da influência política, fenômeno que denominamos de corrupção democracida. Posteriormente, utilizamos o Direito da Segurança para tratar de instrumentos úteis na contenção da criminalidade organizada conforme as dimensões pela qual a segurança pode ser observada. Nesse sentido, pela perspectiva da dimensão da segurança e soberania, realizamos uma abordagem sobre a relevância das atividades de inteligência e de polícia judiciária, a primeira em caráter preventivo e a segunda pelo viés repressivo, no enfrentamento ao crime organizado de naturezas violenta e política e defesa das instituições democráticas. No que tange à dimensão da segurança e cidadania, propõe-se um conceito de segurança política, com caráter antecipatório, através do desestímulo de adesão à criminalidade organizada por meio da promoção de maior cidadania pela ampla representatividade e participação popular na política. Desse modo, aborda-se o regime político brasileiro instituído com Constituição da República de 1988, criticando a estruturação da separação dos poderes, o sistema de governo brasileiro, que se convencionou chamar de presidencialismo de coalizão, além de outros institutos políticos como reeleição irrestrita de parlamentares, emendas parlamentares, sistema eleitoral exclusivamente proporcional, financiamento de campanhas e candidaturas independentes.
