When we dwelve into the subject of the environment, it is noticeable that there are serious and obvious problems, and it can be very tempting to present a series of theoretical and idyllic solutions that could change our course toward the destruction of this great home of ours. However, it becomes much more difficult to turn these theoretical proposals into viable solutions in the real world in which we live. The principle of state sovereignty and the hesitancy of states to relinquish this power is a major obstacle to such a desideratum, as is the pursuit of social and economic development, which so often takes precedence over any other goal. The focus of this presentation will be on both how the environment should be protected and how to ensure such protection, seeking to map the solutions adopted around the world. The two most common themes in this work are the choice of an ecocentric or an anthropocentric position and the role of the courts in the face of the vast panoply of solutions that have been adopted around the world. Finally, I would like to suggest a guideline for the way forward, knowing that there were proposals that were much more ambitious, but perhaps lacking in materiality. I believe in a holistic view of things and that the greatest journeys begin by taking a first step. I believe that this first step has already been taken, but it is necessary to keep moving and to follow that horizon line towards effective environmental protection, which is never reached, but that we can get closer and closer.
