Resumo: This thesis focuses on the study of uncertainties or, in other words, the challenges faced by the regulatory and supervisory bodies of the financial system together with the states, due to the risks generated because of operations carried out with virtual assets (VAs), considering the Angolan reality. Since 2008, the financial sector has undergone significant advances with the introduction of concepts such as crypto-assets and Blockchain, which have since proliferated as a joint result of the progressive integration of financial technologies, such as Distributed Ledger Technology (DLT) and FinTech, as well as those aimed at preventing risks inherent to those, called Disruptive Regulation such as RegTech, and the regulatory Sandbox. Nowadays, the inclusion of these technologies in the global financial system is already a reality. The evolution of the role of these technologies, particularly the framework of virtual assets as their fraction, generate a set of challenges, from a regulatory point of view, that greatly concern the regulators of the financial system, specifically those linked to certain risks such as money laundering, tax evasion and others. These challenges have proved to be quite complex, especially in what concerns the control or inspection of such activities because their regulation implies a different logistics from the traditional model that has fiat currency as its object. Efforts are being made mainly in the sense of adopting a regulatory framework that can respond to such challenges, with much emphasis on the use Disruptive Regulation mechanisms as an appropriate means to mitigate risks. Since it is clear that the phenomenon of financial technologies is one of the reasons, amidst others, for the rapid growth of virtual assets, the present investigation focuses on the operations carried out with such assets, specifically the risks associated with them, and the perspective of their regulation and supervision, considering its adaptation to existing general regulations, as is the case with the framework of money laundering and terrorist financing. These and other questions concerning the risks associated with operations with virtual assets are reflected in this thesis, and particularly lead us to a glimpse of the future from a monetary perspective.

These and other questions concerning the risks associated with operations with virtual assets are reflected in this thesis, and particularly lead us to a glimpse of the future from a monetary perspective.A presente tese tem como objeto o estudo das incertezas ou, se quisermos, dos desafios enfrentados pelos organismos de regulação e supervisão do sistema financeiro em conjunto com os Estados – muito em particular no contexto angolano – por conta dos riscos gerados em função das operações realizadas com ativos virtuais (AVs). Desde 2008 o setor financeiro tem passado por significativos avanços com a introdução de conceitos como o de criptoativos e Blockchain, que desde então foram proliferando, como resultado conjunto da integração progressiva das tecnologias financeiras — como a Distributed Ledger Technology (DLT) e as FinTech —, bem como das direcionadas à prevenção de riscos inerentes àquelas, denominadas Regulação Disruptiva como a RegTech, e a Sandbox regulatório. Em consequência, nos dias de hoje a inclusão destas tecnologias no sistema financeiro a nível mundial é já uma realidade. A evolução do rol dessas tecnologias, particularmente o quadro dos ativos virtuais enquanto sua fração, geram um conjunto de desafios do ponto de vista regulamentar que muito preocupa os reguladores do sistema financeiro, concretamente os desafios ligados a certos riscos como o branqueamento de capitais, fraude, evasão fiscal, e vários outros. Esses desafios têm se mostrado bastante complexos, sobretudo por questões de controlo ou fiscalização das atividades financeiras em causa, isto porque a regulação das mesmas implica uma logística diversa do modelo tradicional que tem como objeto a moeda fiduciária. Logo, os esforços vão sendo realizados principalmente no sentido da adoção de um quadro regulatório que consiga dar resposta a tais desafios, sendo que muito se tem salientado a questão da utilização dos mecanismos de Regulação Disruptiva como meio apropriado para mitigar os riscos em causa. Sendo claro que o fenómeno das tecnologias financeiras tem subjacente, entre outros elementos, o rápido crescimento dos ativos virtuais, a presente investigação centra-se nas operações realizadas com tais ativos, concretamente nos riscos associados às mesmas, na perspetiva da sua regulação e supervisão, e considerando a necessidade de adaptação à regulamentação geral existente, como é o caso do quadro aplicável ao branqueamento de capitais e financiamento ao terrorismo.
