As leis foram analisadas no seu conjunto, desde a primeira, publicada durante o reinado de D. Afonso IV, em 1340, e terminando com o reinado de D. José I, em 1762. A investigação adota uma perspetiva de longa duração, procurando compreender a influência de diferentes épocas e conjunturas na sua promulgação. A abordagem privilegia a História social, averiguando a intencionalidade subjacente à promulgação das leis pragmáticas no que diz respeito à representação dos diferentes grupos sociais. O exercício legislativo baseava-se num conjunto de imagens idealizadas sobre a organização e hierarquização social, por oposição a uma realidade social bastante mais complexa, onde era notória a ascensão de “grupos intermédios”, com capacidade económica para adquirir os artigos de luxo proibidos. Realizaremos um “estudo de caso” para a lei de 1609, procedendo à análise do Livro de Registos de Peças proibidas pela pragmática da cidade do Porto, único registo sobrevivente do seu tipo, através do qual procuraremos conhecer o perfil social dos declarantes de peças proibidas, num esforço de delimitação das elites e grupos ascendentes da cidade.This dissertation consists of an investigation on the subject of the sumptuary laws, publication that were promulgated in Portugal throughout the medieval and, especially, during the early modern period. The laws were analysed from the first, published in 1340 during the reign of King Afonso IV, to the last law of 1762, during the reign of King José I. The research focuses on the long duration, and considers the influence of different historical moments in their promulgation. The subject is approached through the lens of Social History, investigating the intentionality behind the enactment of the pragmatic laws regarding the representation of different social groups, especially the elites, visible in the delimitation of a material culture in agreement with the social category they belonged to. Also, the dissertation analyses the set of theorized ideas of social organization and hierarchization behind the enactment of the laws, and how they contradicted social reality, which was much more complex than its enunciation due to the rise of the "intermediate groups", with the economic capacity to acquire the forbidden goods, but without the corresponding social category. The dissertation finishes with the analysis of a privileged case study for the law of 1609. We analyse the Livro de Registros de Peças proibidas pela pragmática of Oporto, the only surviving record of its type, whereby the inhabitants of the city were compelled to declare the forbidden articles they kept in their possession.
