This paper addresses several legal issues of electronic contracts in the context of internet business environment. In special, it focuses on the freedom of contract in the context of electronic commerce, according to the regulatory framework provided by the European directive on electronic commerce and the implementing Portuguese legislation. Special concerns refer to the conclusion of electronic contract by electronic means, electronic signatures and certification, and consumer protection in e-contracts. It is argued whether Portuguese legislation complies with Community law on the freedom to provide information society services in the internal market by providing additional measures of consumer protection. Moreover, it is also argued whether Portuguese legislation has successfully established a legal framework that improves e-commerce.
