Sendo Macau uma antiga colónia portuguesa, o ordenamento jurídico de Macau teve a sua origem no Direito português e graças ao sistema estabelecido, “um País, dois Sistemas”, derivado da Declaração Conjunta Sino-Portuguesa sobre a Questão de Macau, na medida em que foi previamente acordado e programado por ambos os estados envolvidos. Após a entrega da soberania do território de Macau em 20 de dezembro de 1999, a Assembleia Legislativa de Macau aprovou os grandes Códigos adaptados à realidade e cultura de Macau. O presente trabalho não se assume como uma comparação entre os dois regimes, mas sim como um estudo sobre o regime atual de União de Facto. Todavia, não podemos deixar de abordar, um pouco, a temática sobre o regime de casamento ao longo deste estudo. Além disso, ao observar a redação do n.º 2 do artigo .º da LUF, resulta que a união de facto é a situação jurídica de duas pessoas que, independentemente do sexo, vivam em condições análogas às dos cônjuges, há mais de dois anos.Este trabalho, para além de servir como um pequeno estudo sobre o referido regime nos dois ordenamentos jurídicos (Portugal e Macau), procura, ao observar a redação do n.º 2 do artigo.º da LUF, aferir quando se pode aplicar por analogia as disposições do casamento à união de facto. Vamos, desta feita, tentar procurar a resposta a esta questão ao longo do presente estudo.The purpose of this essay is to present a comprehensive study of the de civil union in Portuguese law and a brief presentation of the same subject in Macau law. Having been a former Portuguese colony, the legal system of Macau had its origin in Portuguese law and because of the established system "one country, two systems” derived from the Sino-Portuguese Joint Declaration on the Question of Macau, insofar as it was previously agreed and programmed by both states involved. After the handing over of the sovereignty of the territory of Macau on December 20th of 1999, the Macau Legislative Assembly approved the Codes adapted to the reality and culture of Macau. This work does not intend to be a comparison between the two regimes, but rather a study of the current Civil Union in both. However, we cannot avoid to mention the marriage throughout this study. In addition, looking at the wording of Article 2.º of the LUF, it appears that the Civil Union is the legal situation of two people who, regardless of sex, have been living under conditions analogous to those of spouses for more than two years.Besides serving as a short study on the regime in both legal systems (Portugal and Macau), this essay also seeks to assess when it is possible to apply by analogy the provisions of marriage to de facto unions by observing the wording of the 2nd paragraph of article no. 2 of the LUF.
