Positive discrimination and negative discrimination of people with non-normative sexuality in the labor context

Resumo: Homosexual workers are constantly victims of discrimination in the workplace. This discrimination can be negatively felt (when your sexuality impairs your experience in the organization), or in a positive way (when in some way your sexuality contributes to your experience in the organization). Thus, the objective of this work was to investigate the aspects that characterize the two types of discrimination (positive and negative) current in the organizational context of workers with a non-normative sexuality. From a qualitative approach, we conduct semi-structured interviews with homosexual workers (gays and lesbians). The results showed that homosexual workers are still highly stigmatized within their organizations and that discrimination based on sexual orientation, although envisaged in the Criminal Code as a crime and protected by the Labor Code, is still a reality based on organizations, affecting both the role of the homosexual worker and his affective life. It was concluded that, although most of the respondents revealed that they were only victims of indirect discrimination, homosexual’s stigma is still very much rooted within organizations.

Esta discriminação pode ser sentida, de forma negativa (quando a sua sexualidade prejudica a sua experiência na organização), ou de forma positiva (quando sua sexualidade contribui para a sua experiência na organização). Assim, o objetivo desse trabalho foi investigar os aspectos que caracterizam os dois tipos de discriminação (positiva e negativa) corrente em contexto organizacional, de trabalhadores com uma sexualidade não-normativa. A partir de uma abordagem qualitativa, realizamos entrevistas semiestruturadas a trabalhadores homossexuais (gays e lésbicas), em Coimbra, Portugal. Os resultados mostraram que trabalhadores homossexuais ainda são muito estigmatizados no contexto laboral e que a discriminação por orientação sexual, apesar de prevista no Código Penal como crime e protegida pela lei do Código do Trabalho, ainda é uma realidade assente nas organizações, a afetar tanto a função do trabalhador homossexual como a sua vida afetiva.
