As repercussões que o procedimento origina na própria gestante, na sua vida pessoal e saúde mental. A figura da gestante afigura-se como frágil e instrumentalizada por uns, e com voz ativa e protegida juridicamente por outros. O risco de instrumentalização da gestante será analisado a par do problema da onerosidade dos contratos, da desigualdade económica, do direito de dispor do corpo e das cláusulas abusivas dirigidas à mesma. O seu papel, a nível de direitos e deveres transmuta-se conforme o ordenamento jurídico onde é exposto e permitido e de acordo com o tipo de contrato aceite legalmente. Como tal, é de ressalvar, a extrema importância, em procurar analisar e refletir, se o papel da gestante, não se encontra a ser descurado por muitos ordenamentos jurídicos, incluindo o nosso. Em Portugal, o sonho de muitos casais, impossibilitados de gerar uma criança por meio de gravidez natural, permanece suspenso, desde 2018, por decisão do Tribunal Constitucional. Decisão essa que tem por base a violação de um direito fundamental da gestante, a dignidade humana. O direito de arrependimento da gestante, é motivo de inquietudes por não se encontrar previsto na legislação e por poder vir a constar, um problema que será analisado em profundidade. Esta investigação, beneficiará de uma abordagem comparativa de modelos, de diversos ordenamentos jurídicos, onde se fará o estudo da figura da gestante, dos seus direitos e deveres distintos ou semelhantes, a Portugal. Por fim, uma breve elucidação de alternativas à gestação de substituição que poderão surgir num futuro próximo.The present research portrays the problem of the rights of the surrogate, particularly in the context of surrogacy. The repercussions that the procedure has on the surrogate herself, on her personal life and on her mental health. The figure of the surrogate appears to be fragile and instrumentalised by some, and with an active voice and legally protected by others. The risk of instrumentalization of the surrogate will be analysed alongside the problem of the onerosity of contracts, economic inequality, the right to dispose of the body and abusive terms addressed to her. Her role, in terms of rights and duties, will be transmuted in accordance with the legal system where it is exposed and permitted and in accordance with the type of contract legally accepted. As such, it is of extreme importance, in seeking to analyse and reflect, if the role of the surrogate is not being neglected by many legal systems, including ours. In Portugal, the dream of many couples, unable to conceive a child through natural pregnancy, has remained suspended since 2018 by decision of the Constitutional Court. This decision is based on the violation of a fundamental right of the surrogate, human dignity. The right of repentance of the surrogate is a reason for concern because it is not provided for in the legislation and may be a problem that will be analysed in depth. This research will benefit from a comparative approach of models, from different legal systems, where the figure of the surrogate, her distinct or similar rights and duties, will be studied in Portugal.
