Inicialmente, começaremos por caracterizar as cláusulas de limitação de benefícios, bem como os diferentes testes que as compõem. De seguida, exploraremos as liberdades fundamentais presentes no Tratado sobre o Funcionamento da União Europeia e de que forma as normas internas dos Estados-membros poderão mostrar-se restritivas dessas liberdades. Analisaremos, então, cada teste que compõe as cláusulas em confronto com as liberdades e concluir quanto à sua compatibilidade ou incompatibilidade.A partir desse pressuposto, iremos oferecer uma crítica à resposta do Tribunal de Justiça da União Europeia quando a questão de compatibilidade destas cláusulas foi invocada no processo ACT Group Litigation. De seguida, abordaremos as nuances do mecanismo de justificação de restrições, com o propósito de investigar a possibilidade da sua utilização no caso das cláusulas de limitação de benefícios. Este mecanismo, atualmente, envolverá um controlo de proporcionalidade, ao qual dedicaremos um capítulo próprio onde poderemos examinar o conceito, os limites e a evolução do controlo de proporcionalidade na jurisprudência do Tribunal de Justiça da União Europeia. Tal será feito em busca de como este tipo de controlo nos poderá ser útil no nosso estudo, eventualmente proporcionando novas propostas de solução da problemática visada neste trabalho. Posteriormente, dedicaremos um outro capítulo à possibilidade de eliminação da incompatibilidade “pela raiz”, tendo em consideração as eventuais consequências da implementação de novas iniciativas anti-abuso.A longo do presente trabalho, conseguimos apresentar, ao todo, três propostas de solução da problemática em questão a ser ponderadas.The present dissertation aims to study the problem of the (in)compatibility of the limitation on benefits clause with the fundamental freedoms granted to all European Union citizens and to find proposals to solve this problem without compromising the fight against tax avoidance. Initially, we will start by characterizing the limitation on benefits clauses, as well as the different tests that they entail. Next, we will explore the fundamental freedoms present in the Treaty on the Functioning of the European Union and how the internal rules of the Member States may restrict these freedoms. We will then analyze each test that makes up the clauses in confrontation with the freedoms and conclude as to their compatibility or incompatibility.Based on that conclusion, we will offer a critique of the response of the Court of Justice of the European Union when the question of compatibility of these clauses was raised in the ACT Group Litigation case. Next, we will address the nuances of the mechanism of restriction justification, with the purpose of investigating the possibility of its use in the case of limitation on benefits clauses. This mechanism, currently, will involve proportionality control, to which we will dedicate its own chapter, where we will be able to examine the concept, limits, and evolution of the proportionality control in the jurisprudence of the Court of Justice of the European Union. We will do this in search of how this type of control can be useful in our study, eventually providing new proposals for solving the problem addressed in this work.
