Resumo: This paper studies the connection between fairy tales and the legal discourse, between the law and theater. As a case study, the analysis is based on The Tale of Tales, by Giambattista Basile, a traditional example of Italian literature, and the short story Le tre corone, which has legal and political elements. The idea is that fables are narratological devices that put together values and archetypes from the collective unconsciousness of certain communities, placed in space and time. Due to that, they are very important in order to understand the literary culture of the Law.

Come case study si concentra su Lo cunto de li cunti, di Giambattista Basile, testo classico della tradizione italiana e sul racconto Le tre corone, di cui evidenzia i contenuti giuridici e politici. Il saggio sostiene la tesi che le favole sono dispositivi narratologici in cui si condensano valori e archetipi dell’inconscio collettivo di determinate comunità, situate nel tempo e nello spazio. Per questo motivo esse sono di grande interesse per la cultura letteraria del dirittoA contribuição analisa a relação entre conto de fadas e discurso jurídico, entre direito e teatro. Como case study, concentra-se em O conto dos contos, de Giambattista Basile, texto clássico da tradição italiana, e no conto Le tre corone, em que se evidenciam conteúdos jurídicos e políticos. O ensaio sustenta a tese de que as fábulas são dispositivos narratológicos nos quais se condensam valores e arquétipos do inconsciente coletivo de determinadas comunidades, situadas no tempo e no espaço.
