Resumo: This paper analyzes the novel by Imre Kertész Kaddish for an unborn child, focusing on the relations between memory, absence and law. Some of the perspectives that the Theories of the Color of Newton and Goethe offer to trace symmetries with a possible Human Rights Color Theory and define, within this theory, white as a color associated with absence, mourning, the impossibility of the emergence of law, a color that is neither illuminated nor transformable in others. The Holocaust is associated with absolute black – not illuminated by law –, which produces the impossibility of memory, the denial of the continuation of the personal stories. The eventual new legal compact that is built after the Holocaust should offer an additional clause: the need to continue with the Law as if. The continuity in the Law now requires including the obligation not to forget the consequences and to contemplate the language of the stories and of the Law itself as an expelled language, which even served to generate a perverted justifiable discourse, and which we can now see as an exiled language which supports the burden of memory and those who can never have a voice.

Utiliza algunas de las perspectivas que las Teorías del Color de Newton y Goethe ofrecen para trazar simetrías con una posible Teoría del Color de los Derechos Humanos, y definir dentro de esta teoría el color blanco como color asociado a la ausencia,al duelo, a la imposibilidad de surgimiento del Derecho, un color no iluminable ni transformable en otros. El Holocausto se asocia al negro absoluto, tampoco iluminable mediante el Derecho, que produce una imposibilidad de memoria, la negación de la continuación de los relatos. El eventual nuevo pacto jurídico que se construye tras el Holocausto debe ofrecer una cláusula adicional: la necesidad de continuar con el Derecho como si. La continuidad en el Derecho exige ahora incluir la obligación de no olvidar las consecuencias y contemplar el lenguaje de los relatos y del propio Derecho como un lenguaje expulsado que llegó a servir para generar un malvado discurso justificatorio, y que ahora podemos ver como una lengua exiliada que soporta la carga de la memoria y de los que no podrán nunca alcanzar una voz.O trabalho analisa o romance de Imre Kertész Kaddish pelo filho não nascido, a partir das relações entre memória, ausência e Direito. Utilizam-se algumas das perspectivas que as Teorias da Cor de Newton e de Goethe oferecem para traçar simetrias com uma possível Teoria da Cor dos Direitos Humanos e definir, dentro dessa teoria, o branco como cor associada à ausência, ao luto, à impossibilidade de surgimento do Direito, uma cor não iluminável nem transformável em outras. O Holocausto se associa ao preto absoluto – não iluminável pelo Direito –, que produz a impossibilidade de memória, a negação da continuação dos relatos. O eventual novo pacto jurídico que se constrói após o Holocausto deve oferecer uma cláusula adicional: a necessidade de continuar com o Direito como se.
