Interfaces between “O alienista” and Foucault's conception of madness: a way out of the legal alienation of madness

Resumo: This article, by means of a jusliterary study, analyzes the elements of the artistic work O alienista by Machado de Assis through the theoretical contribution of Michel Foucault about the relations of knowledge and power that surround madness. The dialogue carried out leads to a critical reading of the interdiction action rules in force in Brazil. It is concluded that the contemporary judicial interdiction is very much similar to the scenario of alienation narrated by the brazilian writer. Faced with so many procedural subjects, the voice of the person in the process of judicial interdiction is either directed by someone, or repressed by the statutes, discourses, and truths infiltrated in this technique, as in a polyphonic novel, where that person is a mere figurant. As a possible “way out” for this legal-procedural alienation, the opposite path is suggested: giving a loud voice and protagonism to the disabled person.

El diálogo realizado conduce a una lectura crítica de la estructura normativa de la acción de interdicción vigente en Brasil. El propio judicial contemporáneo es muy secuencial con el escenario de alienación narrado por el escritor brasileño. Frente a estatutos procesales, la voz del interdicto es a veces dirigida por alguien, a veces reprimida por estatutos, discursos y verdades infiltradas en esta técnica, como en una novela polifónica, donde el interdicto sería un mero extra. Como “salida” a esta acción jurídico-procesal, se sugiere el camino inverso: dar voz y protagonismo al interdicto.Este artigo, por meio de um estudo metodologicamente genealógico e jusliterário, busca articular os elementos da obra “O alienista” de Machado de Assis com o referencial teórico de Michel Foucault acerca das relações de saber e poder que se cingem sobre a loucura, para, então, analisar a estrutura normativa da ação de interdição em vigor no Brasil. Conclui-se que a interdição judicial contemporânea em muito se assemelha com o cenário de alienação narrado pelo escritor brasileiro, pois, diante de tantos sujeitos processuais, a voz do interditando se encontra ora dirigida por alguém, ora reprimida pelos estatutos, discursos e verdades infiltrados nessa técnica, tal como em um romance polifônico onde o interditando seria um mero figurante.
