Resumo: The relationship between the law and narrative fiction goes back to their common origin in rhetoric and in modern Latin America to a shared common past with Spain that begins in Alfonso el Sabio´s Siete partidas, the Recopilación de leyes de Indias de 1681, and the proclamation of constitutions by the new countries that emerge after independence in the early nineteenth century. The most significant of these was the Spanish constitution proclaimed in Cadiz in 1812.  To this is added that many Latin American writers have been lawyers or studied law.  Cecilia Valdés, a novel published in 1882 by Cirilo Villaverde, a Cuban independentist and abolitionist writer in New York, is a historical novel centered in race relations in Cuba during slavery and focused on a family made up of a Spanish father, Cándido and his Cuban wife and children, among them Cecilia, whom he fathered in an illicit relationship with a light mulatta and who looks white.  The main conflict of the novel, other than the overarching one concerning slavery and Spanish colonialism, is focused on the relationship between Cecilia and Leonardo, Cándido´s son, who are not conscious of their being siblings.  A melodramatic plot leads to their marrying and Leonardo being stabbed to death by Pimienta, a mulatto musician who is in love with Cecilia.

La más significativa de estas fue la española, de Cádiz, de 1812. A esto se suma el que muchos escritores latinoamericanos ha sido abogados o han estudiado derecho. Cecilia Valdés, novela publicada por Cirilo Villaverde, un escritor cubano exilado independentista y abolicionista, en Nueva York, en 1882. Es una novela histórica que se concentra en las relaciones raciales en Cuba durante la esclavitud, que gira en torno a una familia compuesta por un padre español, Cándido, su esposa e hijos cubanos, entre estos Cecilia, que tuvo con una mulata clara y que parece blanca. El conflicto principal de la novela, aparte del global sobre la esclavitud y el colonialismo español, lo provoca la relación amorosa entre Cecilia y Leonardo, el hijo de Cándido, que no saben que son hermanos. Una trama melodramática conduce al matrimonio de ambos y al asesinato de Leonardo por Pimienta, un músico mulato enamorado de Cecilia.A relação entre o Direito e a ficção narrativa remete à sua compartilhada origem comum na retórica e, na moderna América Latina, a um passado derivado da Espanha, que se inicia com as Siete partidas, de Alfonso, o Sábio, a Recopilación de leyes de Indias, de 1681, e a proclamação de constituições pelas novas repúblicas após a independência no começo do século XIX. A mais significativa delas foi a constituição espanhola, de Cádiz, em 1812. A isso se soma o fato de que muitos escritores latino-americanos foram advogados ou, então, estudaram Direito. Cecilia Valdés, romance publicado por Cirilo Villaverde, um escritor cubano, independentista e abolicionista, exilado em Nova York, em 1882. Trata-se de um romance histórico que se concentra nas relações raciais em Cuba durante a escravidão, girando em torno de uma família composta por um pai espanhol, Cándido, sua esposa e filhos cubanos, entre eles Cecilia, uma mulata clara, que parece branca. O conflito principal do romance, para além do contexto global da escravidão e do colonialismo espanhol, envolve a relação amorosa entre Cecilia e Leonardo, o filho de Cándido, que não sabem serem irmãos.
