Resumo: This article seeks to discuss the experience of abortion in the context of its criminalization. To do so, based on a methodological proposal of law in literature, two literary works will be analyzed: Happening by Annie Ernaux (2022), based on the author's real-life experience in France in the 1960s; and Looking for Jane by Heather Marshall (2022), a work of fiction set in Canada between 1971 and 1980. While Ernaux's work will be used to discuss the termination of pregnancy as an individual and intimate experience, Marshall's book allows for considerations on abortion as a collective struggle of women. The article develops considerations on both aspects, seeking to translate them to the Brazilian reality, given that, unlike the two countries where the studied books take place, abortion is still considered a crime in Brazil. It is concluded that it is important for the Brazilian legal system to understand the decriminalization of abortion as an expression of women's human rights, so that individuals with uteruses can live their sexuality and reproductive rights with autonomy and dignity.

Para ello, a partir de una propuesta metodológica del derecho en la literatura, se analizarán dos obras literarias: El acontecimiento de Annie Ernaux (2022), basada en la experiencia real de la autora ocurrida en Francia en la década de 1960; y Buscando a Jane de Heather Marshall (2022), una obra de ficción ambientada en Canadá entre 1971 y 1980. Mientras que la obra de Ernaux se utilizará para discutir la interrupción del embarazo como una experiencia individual e íntima, el libro de Marshall permite hacer consideraciones sobre el aborto como lucha colectiva de las mujeres. El artículo desarrolla consideraciones sobre ambos aspectos, buscando traducirlos a la realidad brasileña, dado que, a diferencia de los dos países en los que se sitúan las obras estudiadas, en Brasil el aborto todavía es considerado un delito. Se concluye que es importante que el sistema jurídico brasileño entienda la despenalización del aborto como expresión de los derechos humanos de las mujeres, para que las personas con útero puedan vivir su sexualidad y sus derechos reproductivos con autonomía y dignidad.Este artigo busca discutir a experiência do aborto no contexto de sua criminalização. Para tanto, a partir de uma proposta metodológica do direito na literatura, serão analisadas duas obras literárias: O acontecimento, de Annie Ernaux (2022), baseado na experiência real da autora ocorrida na França, na década de 60; e Procurando Jane, de Heather Marshall (2022), ficção com cenário no Canadá, entre 1971 e 1980. Enquanto a obra de Ernaux será utilizada para discutir a interrupção da gestação enquanto uma experiência individual e íntima, o livro de Marshall permite traçar considerações sobre o aborto enquanto luta coletiva das mulheres. O artigo desenvolve considerações sobre ambos aspectos, buscando traduzi-los para a realidade brasileira, na medida em que, diferente dos dois países em que as obras estudadas tomam lugar, no Brasil o aborto ainda é crime.
