Human rights in “The prisoner” by Erico Verissimo: on the plurality of prisoners, the gears critique and the dilemma of torture

Resumo: This paper approaches the literary work The Prisoner (O Prisioneiro) by the author Erico Verissimo with the objective of proposing a reflection on the prohibition against the practice of torture, mainly from the perspective of International Law and Human Rights. Furthermore, the article explores the dilemma of torture experienced by the character “Lieutenant” and the “Prisioner”, establishing a dialogue between Verissimo's work and the main constitutional, regional and international legal instruments that aim to repudiate, prohibit and penalize the practice of this extreme form of violence. Final considerations include the topicality and the relevance of the social criticism present in the romance The Prisoner for our times, also conjecturing about the reciprocal relationship between the realization of Human Rights and civilizing progress.

Para esto, el artículo explora el dilema de la tortura vivida por el personaje "Teniente" y el “Prisionero”, estableciendo un diálogo entre la obra de Verissimo y los principales instrumentos jurídicos constitucionales, regionales e internacionales que buscan repudiar, prohibir y penalizar la práctica de esta forma extrema de violencia. Se comprueba la relevancia y actualidad de la crítica social presente en la obra El Prisionero para la época actual, conjeturando también sobre la relación recíproca entre la efectividad de los derechos humanos y el avance civilizatorio.O presente trabalho aborda a obra literária O prisioneiro, de Erico Verissimo, com o objetivo de propor uma reflexão sobre a proibição da prática de tortura, principalmente a partir do viés do Direito Internacional e dos Direitos Humanos. Para isso, o artigo explora o dilema da tortura vivenciado pelo personagem “Tenente” e o “Prisioneiro”, estabelecendo um diálogo entre a obra de Verissimo e os principais instrumentos jurídicos constitucionais, regionais e internacionais que visam repudiar, proibir e penalizar a prática dessa forma extrema de violência.
