The uncertain paths of “law and literature”: perspectives and potentialities

Resumo:   Abstract: The present work proposes a cartographic immersion through studies in “Law and Literature”, questioning the possibilities opened by this field in the process of jurist training. Along the way, we analyze the emergence of the Law and Literature Movement in the United States in 1973, as well as the openning works of authors such as Irving Browne, John Wigmore, Benjamin Cardozo and Lon Fuller. We also investigated the consolidation of “Law and Literature” in Brazil, highlighting the pioneering spirit of Aloysio de Carvalho Filho, Gabriel Lemos Brito and, especially, Luis Alberto Warat, whose contributions were and continue to be indispensable for the critical theory of Law.  Therefore, we outline the main theoretical aspects and face some methodological questions that we consider essential for a better understanding and development of this field of research.  Finally, we conclude with a critical reflection on the creative and transgressive potential of artistic and literary experience for legal training.

Además, esbozamos los principales corrientes teóricas y enfrentamos a algunas cuestiones metodológicas que consideramos fundamentales para una mejor comprensión y desarrollo de este campo de investigación.  Finalmente, concluimos con una reflexión crítica sobre el potencial creativo y transgresor de la experiencia artística y literaria para la formación jurídica.O presente artigo propõe uma imersão cartográfica pelos estudos em “Direito e Literatura”, questionando as possibilidades abertas por esse campo no processo de formação do jurista. Ao longo do percurso, analisamos o surgimento do Law and Literature Movement nos Estados Unidos, em 1973, bem como os trabalhos inaugurais de autores como Irving Browne, John Wigmore, Benjamin Cardozo e Lon Fuller. Também investigamos a consolidação do “Direito e Literatura” no Brasil, ressaltando o pioneirismo de Aloysio de Carvalho Filho, Gabriel Lemos Brito e, especialmente, Luis Alberto Warat, cujas contribuições foram e, continuam sendo, indispensáveis para a teoria crítica do Direito. Por conseguinte, esboçamos as principais vertentes teóricas e enfrentamos algumas questões metodológicas que consideramos fundamentais para uma melhor compreensão e desenvolvimento desse campo de pesquisa.
