Law with literature: law as a literary archetype, narratological perspective

Resumo: The present work, based on a perspective of Law in a "strict critical" sense, with an inter and transdisciplinary enclave, and starting from "the juridical" as a functional category expressly created, introduces epistemological issues with methodological extensions through approaches that are disruptive to the usual vernacular criteria within that context. It continues a line of research undertaken a few years ago by the author and addresses three points. One of them will refer to the indisputable link between Law and Literature, in terms of epistemic and egalitarian nexus. Another will address the nature of the literary type that could be attributed to Law, and the last one will account, among other aspects, for the integral advance that legal narratological teoría provides to Law, particularly from a methodological perspective. The development will culminate with some brief conclusions.

The development will culminate with some brief conclusions.El presente trabajo expuesto a partir de una perspectiva del Derecho en sentido “crítico estricto”, con un enclave inter y transdisciplinario, y partiendo de “lo jurídico” como una categoría funcional creada expresamente, se introduce en temas epistemológicos con extensiones metodológicas a través de planteos asaz disruptivos para los criterios vernáculos habituales dentro de ese contexto. Continúa con una línea de investigación emprendida hace pocos años por el autor, y aborda tres puntos. Uno de los ellos referirá a la indiscutible vinculación entre Derecho y Literatura, en términos de nexo epistémico para igualitario. Otro abordará la naturaleza del tipo literario que podría ser adjudicado al Derecho, y el último, dará cuenta entre otros aspectos, del avance integral que la teoría narratológica jurídica provee al Derecho, particularmente desde una perspectiva metodológica. El desarrollo culminará con unas breves conclusiones.Este trabalho, que se insere na perspectiva do Direito em sentido “estritamente crítico”, com um enclave inter e transdisciplinar, e que parte do “jurídico” como uma categoria funcional expressamente criada, investe em temas epistemológicos com extensões metodológicas, com propostas disruptivas, face aos critérios vernáculos habituais  a esse contexto. Dá continuidade a uma linha de pesquisa empreendida há alguns anos pelo autor e aborda três pontos. Um deles se referirá ao indiscutível vínculo entre Direito e Literatura, do ponto de vista de nexo epistêmico para-igualitário. Outro abordará a natureza do tipo literário que poderia ser atribuído ao Direito, e o último dará conta, entre outros aspectos, do avanço integral que a teoria narratológica jurídica proporciona ao Direito, particularmente do ponto de vista metodológico.
