"The controversy", by Carrièrre: the amerindian’s slavery and the modern discourse of human rights

Resumo: | The article aims to articulate the contribution of Jean-Claude Carrière, in The Controversy, with the nascent problem of the relationship between the European and the Amerindians from 1492, and with the defense of human rights for modernity. From the reading of The Controversy, it opted for an analysis focusing on connections between law and literature, considering the scenario and the tensions and interests located in the novel, which were projected on to the normative provisions. The paper analyzes in what sense and why modern enslavement was different from the old one and how discussions, especially those led within the Catholic Church, indicate the germination of a human rights discourse that would only be consolidated centuries later in the bourgeois liberal revolutions. Starting from the reading of the novel, as a fiction, it is also possible to derive to questions about the role of the Spanish and Portuguese kingdoms in this discussion, as well as of the market interests, and what place led indigenous peoples in the approximations and resistances that built this relationship. It was investigated the issue of original peoples in Brazil and the formulation of legal solutions, by examining the concept of subject or personae. Finally, it was listed rules that projected humanist discourse in Brazil. The research demonstrates how these elements were articulated in the literary contribution of Jean-Claude Carrière, under the methodological option of the dialogue between Law and Literature. |

A partir de la lectura de La controversia, optó por un análisis centrado en las conexiones entre el derecho y la literatura, considerando el escenario y las tensiones e intereses ubicados en la novela, que se proyectaron sobre las disposiciones normativas. El artículo analiza en qué sentido y por qué la esclavitud moderna era diferente de la antigua y cómo las discusiones, especialmente las dirigidas dentro de la Iglesia Católica, indican la germinación de un discurso de derechos humanos que solo se consolidaría siglos después en las revoluciones liberales burguesas. A partir de la lectura de la novela, como ficción, también es posible derivar a preguntas sobre el papel de los reinos español y portugués en esta discusión, así como de los intereses del mercado, y qué lugar llevaron a los pueblos indígenas en las aproximaciones y resistencias que construyeron esta relación. Se investigó la cuestión de los pueblos originarios en Brasil y la formulación de soluciones jurídicas, examinando el concepto de sujeto o personae. Finalmente, se enumeraron las reglas que proyectaban el discurso humanista en Brasil. La investigación demuestra cómo estos elementos fueron articulados en la contribución literaria de Jean-Claude Carrière, bajo la opción metodológica del diálogo entre Derecho y Literatura.O artigo articula a contribuição de Jean-Claude Carrière, em A controvérsia, com o nascente problema da relação entre o europeu e os povos originários da América a partir de 1492, e com a origem do discurso e da defesa dos direitos humanos para a modernidade. A partir da leitura de A controvérsia, optou-se pela análise de interface da literatura com o Direito, considerando o cenário e as tensões e interesses localizados no romance, que se projetaram nas disposições normativas coetâneas e atuais. O trabalho analisa em que sentido e porque a escravização moderna foi diferente da antiga e de que modo as discussões, especialmente aquelas protagonizadas dentro da Igreja Católica, indicam a germinação de um discurso dos Direitos Humanos que somente seria consolidado séculos depois, nas revoluções liberais burguesas. Partindo da leitura do romance, enquanto obra de ficção, também é possível derivar para indagações sobre qual o papel dos reinos espanhol e português nessa discussão, bem como dos interesses mercantis, e qual o lugar protagonizado povos indígenas nas aproximações e resistências que construíram essa relação e seus lugares. Desenvolveu-se uma pesquisa sobre a questão dos povos originais no Brasil e a formulação de soluções jurídicas, partindo do conceito de sujeito ou personae. Por fim, foi feita uma sistematização de dispositivos normativos que projetam o discurso humanista.
