Driving forces, challenges, and possible ventures in socio-legal (empirical legal) research in Brazil

Resumo: In Brazil, socio-legal (empirical legal) research (SL/ELR) has become an exhilarating, inspiring, and encouraging scholarly terrain. Yet, the chance to celebrate this condition shall not blind us to the historical and structural obstacles against which it was erected, nor shall it prevent us from critically assessing the challenges SL/ELR still faces ahead in order to get established – many of which, in fact, stem from new circumstances and, therefore, are not yet completely understood. This article seeks to contribute to such discussion. Through a review of the literature, primary data collection, and aspects of the author’s own experience, it examines what it calls driving forces, challenges, and possible ventures in socio-legal (empirical legal) research.

Mas eventual interesse em celebrar ou promover essa condição não deve ocultar os obstáculos históricos e estruturais contra os quais ela foi erigida, tampouco arrefecer o exercício da nossa consciência crítica sobre os desafios com os quais a PED se defronta para se afirmar no tempo e no espaço – muitos dos quais, aliás, derivam exatamente das novas circunstâncias e, por isso mesmo, apenas muito lentamente se fazem enxergar. Este artigo busca contribuir com essa reflexão.
