From the right to torture: population and individual scales of torture in socio-education

Resumo: | Torture is an ancient practice that crosses continents. In Brazil, although prohibited and criminalized, it continues to be exercised. Currently it presents a series of variations that are in dispute at the conceptual, political and legal scope in Brazil and world-wide. In this work, based on a case study, I have made an analysis of the variations of torture, identified from a fire that occurred in a Juvenile Detention Center in Rio de Janeiro/Brazil, registered by an inspection body for the deprivation of liberty spaces, the Rio de Janeiro's State Mechanism to Prevent and Combat of Torture. It was observed that the precarious and old architecture of the unit, the overcrowding and the limited or inadequate access to health services, are configured as torture practices against this population, which articulate itself with practices of individualized violence. Such actions are articulated and implementeded by several institutions, showing that torture practices are configured based on power relations, settled in inequalities. |

No Brasil, ainda que proibida e criminalizada, segue sendo exercida. Atualmente apresenta uma série de variações que estão em disputa no âmbito conceitual, político e jurídico no país e no mundo. Neste trabalho, a partir de um estudo de caso, faço uma análise das variações da tortura, identificadas a partir de um incêndio ocorrido em uma unidade socioeducativa do Rio de Janeiro, registrado por um órgão de fiscalização dos espaços de privação de liberdade, o Mecanismo Estadual de Prevenção e Combate à Tortura do Rio de Janeiro. Observou-se que a arquitetura precária e antiga da unidade, a superlotação e o acesso limitado e inadequado aos serviços de saúde se configuram em práticas de tortura no corpo populacional, e ainda se articulam com práticas de violência individualizada.
