The challenges of socio-environmental legal effectiveness in the transition from the Controlled Landfill of “Estrutural” to a Rubble Receiving Unit: social problems, water, soil and air contamination

Resumo: The closure of the Controlled Landfill in Brasília-DF, formerly “Lixão da Estrutural”, still presents challenges of socio-environmental legal effectiveness related to the waste management area. This can be seen from a diagnosis of solid waste management in the Federal District when considering the social problems faced by waste pickers and the environmental contamination promoted by the aforementioned landfill that, for decades, promoted the degradation of the local environment. The research was carried out via analysis of administrative processes related to the referred Landfill (requested from the local government via the information access system), as well as some decisions held in the local court; complemented by a bibliographic review related to scientific findings of the contamination of the area. The actions taken by the local government were evaluated, as well as compliance with the legislation related to waste, and the technical standards relevant to contamination. On the one hand, there is a finding of a chronic technological disaster related to the social and environmental issues of the referred landfill, given the different forms of contamination of soil, air, water and harmful. In addition, there are effects to the population working directly in the area and its surroundings, as well as social problems involving waste pickers and non-compliance with isolation measures. On the other hand, efforts are being made to improve waste management, by observing public policies adopted by the local government, in favor of better management of solid waste in the Federal District: these were mapped and classified according to the model proposed by Lowi, in addition to Fray and a reflection on coregulation as an important tool in waste management in the Federal District.

É o que se percebe a partir de um diagnóstico do estado do gerenciamento dos resíduos sólidos no Distrito Federal, ao se considerar os problemas sociais enfrentados pelos catadores e a contaminação ambiental promovida no local durante décadas. A pesquisa foi realizada via consulta aos órgãos de gestão de resíduos (solicitados ao governo local por meio do sistema de acesso à informação), bem como a partir de algumas decisões do Judiciário; complementada por uma revisão bibliográfica sobre pesquisas científicas que demonstram a contaminação na área. Avaliou-se as ações adotadas pelo governo local, bem como o cumprimento da legislação relacionada a resíduos, e das normas técnicas pertinentes à contaminação. Por um lado, há a constatação de um desastre tecnológico crônico relacionado a questões sociais e ambientais do referido aterro, ante as diferentes formas de contaminação do solo, do ar, da água. Além disso, observam-se efeitos nocivos à população que trabalha diretamente na área e no seu entorno, problemas sociais envolvendo os catadores e o descumprimento das medidas de isolamento.
