The recent characterizations of moral damage in the Superior Court of Justice: pretium doloris or prejudice in re ipsa?

Resumo: Despite being a widely known and used concept, the requirements for configuring personal injury in concrete cases remain controversial in juridical literature and in courts. In the characterization of personal injury and in the setting of its pecuniary compensation, there is the influence of three different point of views: one that understands that personal injury is characterized by suffering, other that recognizes the damage as an injury to the personality right and a third line of thought that assumes that personal injury is presumable and one must demonstrate the harmful event and not the victim’s bad feelings. It is therefore necessary and useful to verify how the most recent case law of the Superior Court of Justice comprehends these requirements. To achieve the intended end, this research adopted as methodology a systematic review of case law, specifically relying on statistical analysis of tried cases in the scope of the STJ divisions.

Na caracterização do dano moral e na fixação da sua compensação pecuniária (o quantum) há a influência de três pontos de vista: um que entende que dano moral é caracterizado pelo sofrimento (pretium doloris), outro que vê o dano como lesão a direito da personalidade e uma terceira corrente teórica que entende que o dano moral é presumível e deve-se comprovar o evento danoso e não os sentimentos ruins da vítima (in re ipsa). Mostrou-se, assim, necessário e útil, verificar como a jurisprudência mais recente do Superior Tribunal de Justiça compreende esses requisitos.
