THE CORRECTIONAL CHARACTER OF SOCIO-EDUCATIONAL POLICY IN BRAZIL: A CRITICAL ANALYSIS

Resumo: | This article discusses part of research that aimed to deepen the concept of socio-educational, used within the scope of socio-educational measures provided for in the Statute of Children and Adolescents (ECA) applied to adolescents who commit infractions, from a historical materialist perspective and dialectic. The objective was to critically analyze, from official documents that deal with socio-educational measures, how adolescents have been seen and treated within the scope of socio-educational policy. The analysis was carried out from the construction of meaning cores apprehended in the document reading. It was demonstrated that, despite the apparent discourse of Integral Protection to the adolescent who committed an infraction and the change of paradigm in the socio-educational policy, there is a predominance of a proposal of socio-educational practice with a correctional bias. It is noticeable that the idea of guaranteeing the right is restricted only to bourgeois citizenship in an uncritical way, so much so that it is accompanied by the affirmation of the need to guarantee the security of the population, that is, guarantee the social order. Therefore, after more than thirty years of enactment of the ECA, the minority practice is still in force when it comes to teenagers who commit infractions. However, a proposal of emancipatory socio-educational will only be possible if it has is its starting point the social historical context of Brazil. Disregarding the class and color cut when it comes to juvenile offenders is to hide the reality of Brazilian socio-educational. |

Este artículo aborda parte de una investigación que tuvo como objetivo profundizar el concepto de socio educación, utilizado en el ámbito de las medidas socio educativas previstas en el Estatuto de la Niñez y la Adolescencia (ECA) aplicadas a los adolescentes que cometen infracciones, desde una perspectiva histórica materialista y dialéctica. El objetivo fue analizar críticamente, a partir de documentos oficiales que versan sobre medidas socio educativas, cómo han sido vistos y tratados los adolescentes en el ámbito de la política socio educativa. El análisis se realizó a partir de la construcción de núcleos de sentido aprehendidos en la lectura documental. Se demostró que, a pesar del aparente discurso de Protección Integral al adolescente que cometió una infracción y el cambio de paradigma en la política socio educativa, predomina una propuesta de práctica socio educativa con sesgo correccional. Llama la atención que la idea de garantizar el derecho se restringe solo a la ciudadanía burguesa de manera acrítica, tanto que se acompaña de la afirmación de la necesidad de garantizar la seguridad de la población, es decir, garantizar el orden social. Por lo tanto, luego de más de treinta años de promulgación de la ECA, la práctica minoritaria sigue vigente cuando se trata de adolescentes que cometen infracciones. Sin embargo, una propuesta de socio educación emancipadora solamente será posible si tiene como punto de partida el contexto histórico social de Brasil. Ignorar el corte de clase y color cuando se trata de menores infractores es ocultar la realidad de la socia educación brasileña. Este artigo discute parte de uma pesquisa que teve como objetivo o aprofundamento do conceito de socioeducação, utilizado no âmbito das medidas socioeducativas previstas no Estatuto da Criança e Adolescente (ECA) aplicadas a adolescentes que cometem atos infracionais, a partir de uma perspectiva materialista histórica e dialética. O objetivo foi analisar criticamente, a partir dos documentos oficiais que versam sobre as medidas socioeducativas, de que maneira os adolescentes vêm sendo visto e tratados no âmbito da política de socioeducação. A análise foi realizada a partir das construções de núcleos de significação apreendidos na leitura documental. Ficou demonstrado que, apesar do aparente discurso de Proteção Integral ao adolescente autor de ato infracional e de mudança de paradigma na política de socioeducação, há predominância de uma proposta de prática socioeducativa com viés correcional. É perceptível que a ideia de garantia de direito se restringe apenas à cidadania burguesa de forma acrítica, tanto é assim que vem acompanhada com a afirmação da necessidade de garantir a segurança da população, ou seja, garantir a ordem social. Logo, passados mais de trinta anos de promulgação do ECA, a prática menorista ainda vigora quando se trata de adolescentes autores de atos infracionais. Todavia, uma proposta de socioeducação emancipatória só será possível se tiver como ponto de partida o contexto histórico social do Brasil.
