TRANSITIONAL JUSTICE, MILITARY FORCES AND PUBLIC SECURITY IN BRAZIL: FAILURES IN THE INSTITUTIONAL REFORMS DIMENSION

Resumo: The main objective of this paper is to analyze the flaws in the institutional reforms dimension of Transitional Justice in Brazil, specifically with regard to the Military Forces and Public Security in general. Although the 1988 Brazilian Federal Constitution carried out important institutional reforms regarding the Rule of Law structure, it is noted that there was no deep change in these sectors, which often repeat not only the organizational structure, but authoritarian practices and discourses that referto the dictatorship established in the 1964 Coup. The research is based on an analytical and exploratory methodology, with a theoretical framework of Human Rights, Political Science and History. The data presented are from public bodies and was compiled through the Brazilian Public Security Forum. The research is still ongoing, but it is partially concluded by the insufficiency of institutional reforms in the Military Forces and Public Security in relation to Brazilian Transitional Justice and the need for a review of this transitional dimension through a Transitional Justice process focused on public policies aimed at institutional reforms in the military and police system and adoption of the Citizen Security paradigm, making it possible to overcome practices such as police violence authoritarian speeches, apologies for the military dictatorship in these sectors of public life, contributing to the strengthening of the Brazilian Democracy and Rule of Law.

Apesar da Constituição Federal de 1988 ter realizado importantes reformas institucionais no tocante à estrutura do Estado Democrático de Direito, se nota que não houve uma profunda mudança nestes setores, que muitas vezes repetem não só a estrutura organizacional, mas práticas e discursos autoritários que remetem à ditadura estabelecida no Golpe de 1964. A pesquisa é baseada em metodologia analítica e exploratória, com referencial teórico de Direitos Humanos, Ciência Política e História, os dados apresentados são originários de órgãos públicos e foram compilados através do Fórum Brasileiro de Segurança Pública. Subsidiariamente serão utilizadas a legislação e documentos oficiais como o Relatório da Comissão Nacional da Verdade (CNV), bem como notícias de sites jornalísticos de ampla abrangência nacional ou internacional.
