Resumo: Analisa os elementos processuais observados no Protocolo de Malabo e quais elementos podem ser destacados em relação às suas ligações com o Tribunal Penal Internacional. Apresenta as tensões entre a União Africana e o Tribunal Penal Internacional que levaram à aprovação do Protocolo de Malabo. Conclui que a norma tem poderes muito mais limitados do que os prometidos por suas nações proponentes.
