Relata a sua origem, função, pressupostos específicos e casos de cabimento, diferenciando-o do Recurso Extraordinário. Examina e apresenta importantes reflexões sobre o inciso III do artigo 105 da Constituição de 1988, que trata da competência do Superior Tribunal de Justiça em relação ao Recurso Especial. Analisa os requisitos de cabimento como o preqüestionamento da questão federal, as súmulas nº 282 e 356 do Supremo Tribunal Federal e a nº 211 do Superior Tribunal de Justiça. Avalia se cabe Agravo Regimental da decisão que dá provimento a agravo para converter ou mandar subir o Recurso Especial; se cabem Embargos de Divergência da decisão que julga o Agravo Regimental; se os Embargos de Divergência podem ser julgados monocraticamente; se ocorre trânsito em julgado da decisão final se o agravo não foi julgado; e, se cabe Reclamação, Agravo de Instrumento, Medida Cautelar ou petição no destrancamento de Recurso Especial e decisão interlocutória.
