Resumo: Debate as funções da pena, destacando a função preventiva da pena privativa de liberdade, nas suas acepções positiva e negativa. Elucida as críticas pertinentes à temática, ressaltando o paradoxo entre a realidade infraestrutural e psicológica do sistema prisional brasileiro e o papel ressocializador da pena, seara na qual projetos-modelo de reintegração social emanam como exceções, cujos métodos constituem exemplos a serem incentivados e concretizados.
