The practice of consensualism in the Court of Auditors of Mato Grosso through the Technical Boards: effectiveness of dialogical control

Resumo: The aim of this paper is to present the theoretical background and the implementation of the Technical Boards, which have been adopted as a consensualist procedure within the Mato Grosso State Court of Auditors. The aim is to demonstrate that the evolution and transformation of the sanctioning logic of traditional external control mechanisms, brought about by the spread of institutional dialogue and consensualism, have culminated in the implementation of new techniques and procedures that are important for achieving democratic constitutional objectives and values. In view of this, the paper is based on the following problem: what is the legal nature of the Technical Boards set up by the Mato Grosso Court of Auditors, and what influenced the creation of this new procedure? To this end, the deductive technique and bibliographic review procedure are adopted, firstly to present the consensual and dialogical institutes developed within the Powers, and then specifically to present the institution of the Technical Boards within the Mato Grosso Court of Auditors, based on the delimitation of the existing regulatory framework and the presentation of some of the cases processed before them, which demonstrate the effectiveness of external control through this consensual procedure. The study shows how the resolution of administrative conflicts through the Technical Boards is in line with the national and international policies of pacifying social relations and how it can bring significant benefits.

Busca-se demonstrar que a evolução e a transformação da lógica sancionadora dos mecanismos tradicionais de controle externo, operada pela difusão do diálogo institucional e do consensualismo, culminaram na implementação de novas técnicas e procedimentos importantes para a concretização de objetivos e valores constitucionais democráticos. Em vista disso, o artigo parte da seguinte problemática: qual a natureza jurídica das Mesas Técnicas instituídas pela Corte de Contas mato-grossense e o que teria influenciado a criação desse novo procedimento? Para tanto, adota-se a técnica dedutiva e o procedimento de revisão bibliográfica, dedicando-se, em um primeiro momento, à exposição dos institutos consensuais e dialógicos desenvolvidos no âmbito dos Poderes, para, então, apresentar especificamente a instituição das Mesas Técnicas no âmbito da Corte de Contas mato-grossense, a partir da delimitação do marco regulatório existente e da exposição de alguns dos cases processados perante elas, que demonstram a efetividade do controle externo através desse procedimento consensualista. O estudo demonstra como a resolução de conflitos administrativos por meio da Mesa Técnica se alinha com a política nacional e internacional de pacificação das relações sociais e como ela pode trazer benefícios significativos para o sistema de controle externo.
