A Constituição de 1988 e o Código Civil trouxeram grandes mudanças, principalmente na área de família. Passou-se a analisar a paternidade socioafetiva, construída no afeto e na convivência familiar, consagrando, assim, a afetividade no direito de família. Após todas essas mudanças as relações que permaneciam no mundo fático foram inseridas no mundo jurídico. O ordenamento jurídico também vislumbrou a posse de estado de filho, que se constitui no direito brasileiro pela a adoção à brasileira e a adoção nuncupativa. A adoção à brasileira é uma adoção informal, quem realiza tal adoção pega o menor da mãe biológica e o registra como sendo seu filho, dando ao infante seu próprio nome. A adoção nuncupativa é caracterizada pelo desejo de criar, pela afeição, aceitação, guarda de uma pessoa, com todos os cuidados de um filho. Essas adoções são hoje tratadas como parentesco socioafetivo. Atualmente ocorrem conflitos entre os interesses patrimoniais e a paternidade socioafetiva. Assim, serão estudados os direitos garantidos a esses adotados, uma vez que, se faz necessário garantir a dignidade e o orgulho de se pertencer a um grupo familiar.The Present work has as mark to study the Brazilian and nuncupative adoptions and their reflexes in the juridical ordainment. The Constitution of 1988 and the Civil Code brought great changes, mainly in the family area. It started to analyze the socioaffective paternity, built in the affection and in the family coexistence, consecrating, like this, the affectivity in the rights of family. After all those changes the relationships that stayed in the fact world were inserted in the juridical world. The juridical ordainment also glimpsed the ownership of son's state, that is constituted in the Brazilian right by the Brazilian adoption and the nuncupative adoption. The Brazilian adoption is an informal adoption, whom accomplishes such adoption catches the biological mother's child and it registers him how his/her son being, giving to his/her infant your own name. The nuncupative adoption is characterized by the desire of creating, for the affection, acceptance, keeps of a person, with all a son's cares. Those adoptions are treated today as socioaffective relationship. Now they happen conflicts between the patrimonial interests and the socioaffective paternity.
