Busca-se, ainda, identificar o posicionamento jurisprudencial e doutrinário, os argumentos favoráveis e contrários ao reconhecimento da união estável homoafetiva, bem como as perspectivas das uniões homoafetivas no direito pátrio. Assim, adotou-se uma pesquisa de cunho sociojurídico e natureza exploratória, pautada na revisão bibliográfica, pois se busca substratos na doutrina, legislação e jurisprudência para compreender a problemática da união estável homoafetiva. Buscou-se compreender os institutos da união estável e do casamento, em especial os seus requisitos, a proteção constitucional e infraconstitucional destinada a essas modalidades de entidade familiar para, então abordar o fenômeno da homossexualidade. Viu-se que apesar de inexistir previsão legal para as relações homoafetivas, essas não estão isentas de proteção, principalmente porque o constituinte positivou os princípios da dignidade da pessoa humana e da igualdade, que veda qualquer espécie de discriminação. Concluiu-se, ao final, que apesar da proteção principiológica, e do reconhecimento recente pelo Supremo Tribunal Federal da natureza de entidade familiar, as uniões homoafetivas podem ser reconhecidas como união estável, mesmo que seja para estas é imprescindível a diversidade de sexo. Logo, para que seja equiparada a casamento, se fará necessária a alteração no art. 226, § 3º, da Constituição da República de 1988, sob pena de haver clara afronta ao texto constitucional.The present study aims to examine the homoaffective stable in the face of the requirements of marriage, especially the diversity of sex. The aim is also to identify the position of jurisprudence and doctrine, the arguments for and against of homoaffective stable, and the prospects of unions in homo affective parental rights. Thus, we adopted a research and exploratory nature, based on the literature review, as it seeks substrates on doctrine, legislation and case law to understand the problem of recognition, the stable homo affective. We sought to understand the institutions of marriage and stable relationships, especially their requirements, the constitutional protections and infra aimed at these types of family entity to then approach the phenomenon of homosexuality. It was found that despite the non-existence of legal provision for relations homo affective, these are not without protection, mainly because the constituent legislated the principles of human dignity and equality, which prohibits any kind of discrimination. It was concluded at the end, that despite the principled protection, and the recent recognition by the Supreme Court of the nature of a family unit, homo affective unions can be recognized as stable, since for such diversity is essential for sex. Soon to be treated as marriage, the change will be needed in the art. 226, § 3 of the Constitution of 1988, otherwise there is a clear affront to the constitutional text.
